Malone University Community Responsibilities
Copies of the Malone University Community Responsibilities statement and policy are on file in the Office of Student Development and available to all students upon request. Students may also consult the undergraduate Malone University Catalog for this information.
Computer Software Policy
Software purchased by Malone University remains the property of the University or of the vendor as agreed by license. Such software, whether in source or object form, including its design, file structures, and any other tangible or intangible value may not be accessed, copied, or removed from the system, nor disclosed to any third party without prior consent of the owner.
Duplicating copyrighted software violates the U.S. Copyright Law. It is a federal offense. Criminal penalties include fines and imprisonment. Illegal copying is not permitted at Malone University. Members of the Malone University community should view violations of the above as violations of the Community Responsibilities, Attitudinal and Behavioral Expectations, sections 3) and 4).
Those in violation of this policy are subject to the normal judicial procedures specified for violations of the Malone University Community Responsibilities.
Drug-free Workplace Statement
Malone University policies prohibit the unlawful manufacture, distribution, dispensing, possession, or use of a controlled substance in the workplace and specify actions that will be taken against employees or students found in violation.
Family Educational Rights and Privacy Act
Each year, Malone University is required to give notice of the various rights accorded to parents or students pursuant to the Family Education Rights and Privacy Act (“FERPA’’). Parents and students, under FERPA, have a right to be so notified and informed. In accordance with FERPA, students are notified of the following:
- Right to Prevent Disclosures
Students have the right to prevent disclosure of Education Records to third parties with certain limited exceptions. It is the intent of Malone University to limit the disclosure of information contained in students’ Education Records to those instances where prior written consent has been given for the disclosure, as an item of directory information for which students have not refused to permit disclosure, or under the provisions of FERPA which allow disclosure without prior written consent.
- Right to Inspect
Students have the right to review and inspect all of their Education Records maintained by or at Malone University.
- Right to Request Amendment
Students have the right to seek to have corrected any parts of any Education Record, which they believe to be inaccurate, misleading, or otherwise in violation of their FERPA rights. This right includes the right to a hearing to present evidence that the record should be changed if Malone University decides not to alter the Education Records according to the request.
- Right to Obtain Policy
Students have the right to obtain copies of the written institutional policy adopted by Malone University in compliance with FERPA. Copies may be obtained in person or by mail from the Office of the Registrar located in Founders Hall.
- Right to File a Complaint within the FERPA Office
Students have the right to file complaints with the Family Educational Rights and Privacy Act Office, at the Department of Education, 600 Independence Avenue, S.W., Washington, D.C. 20202-3887, 202.260.3887, FAX: 202.260.9001, concerning any belief that Malone University has failed to comply with the provision of FERPA.
Human Research Policy
Research which involves members of the Malone University community (as investigators or participants) and makes use of human subjects is evaluated and approved by the Institutional Review Board (IRB) before data collection begins. The IRB exists to ensure the ethical treatment of human subjects by maintaining compliance with established ethical guidelines and federal regulations (e.g., The Belmont Report; guidelines put forth by the U.S. Department of Health and Human Services’ Office for Human Research Protections; 45 CFR 46; and guidelines set forth by the FDA).
Nondiscrimination Policy
Malone University has an established policy of equal academic and employment opportunity. This policy is applied to all qualified students, employees, and applicants for admission or employment, in all University programs and activities, without regard to race, color, religion, national origin, sex, age, disability or veteran status, as defined and required by law.
Discrimination Complaint Procedure
An internal complaint procedure has been established for the prompt and equitable resolution of complaints alleging any action prohibited by Section 504 of the Rehabilitation Act of 1973, as amended (involving disability discrimination), the Americans with Disabilities Act, as amended (to the extent applicable to the University), Title VI of the Civil Rights Act of 1964, as amended, the Age Discrimination in Employment Act of 1975, as amended, or Title IX of the Education Amendments of 1972, as amended (involving sex discrimination).
If you believe you may have been discriminated against in violation of this policy or if you have any questions regarding this policy, please immediately contact the appropriate designated Discrimination Complaint Coordinator listed below. Printed copies of the Discrimination Complaint Procedure may be obtained from any of the designated individuals listed below, the Office of Student Development, the Human Resources Office, or the University’s website, www.malone.edu/d47.

- Students or employees also may elect to contact the Vice President for Finance 330.471.8238, office location: Founders Hall or mailing address: Malone University, 2600 Cleveland Avenue N.W., Canton, OH 44709. The Vice President for Finance also is the designated Title IX and Section 504 coordinator for the University.
Release of Directory Information while at Malone University
The Family Educational Rights and Privacy Act of 1974 permits Malone University to release directory information about students. Directory (public) information includes the student’s name, local (mailing) address, telephone listing, date of birth, major field of study, participation in officially recognized activities and sports, the student’s photograph, weight and height of members of athletic teams, dates of attendance, degrees and awards received, and the most recent previous educational agency or institution attended by the student. If students do not wish to have Directory information released by Malone University, they must notify the Office of the Registrar more than (10) days prior to the starting date of the semester or summer session for the request/instructions to be effective for that semester or summer session. Written requests must be presented to the Office of the Registrar located in Founders Hall and must be renewed annually.
Student Accessibility Services
Student Accessibility Services has been designated to provide services for qualified students with disabilities in order to maximize their educational opportunities and academic potential.
Students seeking services must provide current documentation of their specific disabilities (physical, learning, or psychological). The center can provide and/or arrange accommodations, auxiliary aids, referrals for testing, and counseling support.
Students with disabilities should call the center for individual pre-enrollment appointments if they choose to self-disclose their disabilities and plan to request academic accommodations. Upon receipt of the correct and complete documentation of the disability, the Director will work with them to determine appropriate accommodations. They will then be responsible to request these accommodations prior to the start of each semester for as many of their classes as they so choose.
Student Accessibiity Services is located on the second level of the Randall Campus Center (the ‘Barn’). Students with questions may contact the Director at ext. 8496.
Student Records
Malone University has a policy of administering and maintaining student records which is in compliance with the Family Educational Rights Privacy Act of 1974. This policy provides students with certain rights of access to these educational records as delimited in FERPA. Directory information is subject to release by the University and includes the student’s name, local and permanent address, telephone listing, major, participation in officially recognized activities and sports, weight and height (if a member of an athletic team), dates of attendance, degrees and awards received, place of high school graduation, and most recent educational institution attended.
Students wishing to restrict access to directory information must file a written request with the Office of the Registrar. The complete policy concerning this Act is available upon request from the Office of the Registrar.
Unlawful Harassment
The ongoing policy of Malone University is to provide all students with an environment free from all forms of unlawful harassment or discrimination. This includes any unlawful harassment or discrimination based upon race, ancestry, color, national origin, disability or handicap, age or sex.
Sexual harassment deserves special mention. According to Federal guidelines, unlawful sexual harassment includes unwelcome sexual advances, requests for sexual favors, and other verbal or physical contact of a sexual nature.
Unlawful harassment may include, without limitation, any verbal slur, negative stereotyping, hostile or demeaning act (including jokes or teasing) or written or graphic material that shows animosity, aversion, or disparagement toward an individual or group, based upon race, color, national origin, disability or handicap, age or sex. The University does not permit or condone any unlawful harassment of or by any student of the University, on campus or in connection with University-related activities.
Any student found to have engaged in any unlawful harassment of another student, or of an employee, contractor or visitor of the University, will receive prompt and appropriate disciplinary action, up to and including dismissal from the University. Appropriate disciplinary action also will be taken against any student found to have willfully falsified any claim of unlawful harassment.
It is the policy of the University to investigate all complaints of unlawful harassment thoroughly and promptly, and to keep such complaints and terms of their resolution confidential, to the extent reasonably practicable. No reprisal, retaliation, or other adverse action will be taken by the University against any student because he or she, in good faith and without proven falsification, claims to be a victim of or to have observed or heard, unlawful harassment on campus or in connection with University-related activities, or because such student assists in the investigation of any such matter.
Any graduate student who feels that he or she has been subjected to, or falsely accused of, unlawful harassment, on campus or in connection with University-related activities, and who is unable to resolve such matters promptly and satisfactorily with the offending party, should submit detailed verbal and written reports. Based on the student’s program, reports should be submitted to the appropriate Program Director.
Weather Policy
Does Malone University close for bad weather in the winter? The answer is yes, BUT VERY INFREQUENTLY. The policy followed here is similar to that of other colleges and universities, which could lead to a situation in which various public school systems will be closed while Malone remains open. If there is a heavy snowfall or other emergency which would necessitate the canceling of classes or the closing of the campus, announcements will be made over local radio stations and on all the Cleveland television stations. In addition, there will be a SPECIAL BULLETIN posted on the Malone University homepage (www.malone.edu) that will also provide closure and cancellation advisories. When day classes are to be canceled, the stations will normally be prepared to announce the closing by 6:30 a.m. If evening classes are to be canceled, an announcement will usually be made by 3:30 p.m. In either case, please do not call the stations or the Malone University number. The stations typically make an announcement on the air within a few minutes of our call to them. In the event weather conditions gradually deteriorate during late afternoon or evening hours, or in anticipation of a storm or hazardous road conditions, the instructor has the authority to issue an early dismissal for a class session.

Admission or Readmission of Students with Prior Convictions and Disciplinary Records
Malone University is committed to a policy of maintaining a safe environment for all members of the University community. Pursuant to that policy, the University requires applicants for admission or readmission who have received certain types of serious disciplinary action from educational institutions, or who have been convicted of any crime other than minor traffic violations, or who currently are under indictment or prosecution for any such crime, to disclose such information, as a mandatory step in the application process. Such disciplinary action, prior conviction, or current indictment or prosecution does not automatically bar admission to the University, but any such matter does require review and may result in rejection from admission or readmission. |
